OFFICIAL DANCE TRACK ARTIST AWARDS RULES
1a. DANCE TRACK ARTIST AWARDS

- Dance Track Foundation will honor winners of Artist Awards categories based on the submission criteria, editorial staff and industry expert selections.
- Dance Track Foundation invites professional dancers and choreographers to submit themselves or deserving nominees in the categories outlined for this year’s awards.
- Dance Track Foundation’s Artist Awards nomination process will occur in two stages. At Stage 1, eligible submissions will be tallied for nominations in each category. At Stage 2, the accepted submissions receiving the top 3 highest number of submissions per category will be selected to move on as official Artist Awards “Nominees” in their respective categories. Each eligible submission will be reviewed (on December 31, 2011) and the top 3 “Nominees” in each category will be placed on a ballot for dancers and choreographers to vote for their choice as winner. Only eligible dancers and choreographers will be allowed to vote (See Stage 2 of Paragraph 6).
- For the submissions in the open voting categories, the top 5 submissions as determined by tally of the submission numbers by the Dance Track Foundation officers will be placed on the Dance Track Foundation Web site for viewing at www.DanceTrackFoundation.org and ArtistAwards.net (the “Sponsor Web sites“) and will be judged as part of the Artist Awards in accordance with paragraph 6 below.
1b. ARTIST AWARDS RECOGNITION
As well as offering a physical award to the winning submission, Dance Track Foundation has partnered with Dance Track Magazine and will showcase the winners in a Special Artist Awards Digital 2012 issue of Dance Track Magazine and online at www.DanceTrackMagazine.com. Further details on the prize for the Dance Track Artist Awards are set out in paragraph 7 below.
1c. The Nominating Period begins on November 1, 2011 at 9:00 am Pacific Standard Time, when submissions will first be accepted, and ends on December 31, 2011 at 11:59 pm Pacific Standard Time, when nominating submissions closes.
1d. Dance Track Foundation (as defined in paragraph 2a below) is the creator and sponsor of the ‘Artist Awards.’

2. THE RULES AND THE TERMS AND CONDITIONS
2a. In these Rules, “Dance Track Foundation” means Dance Track Foundation, a non-profit organization and acting on its own behalf.
2c. These Official Dance Track Artist Awards Rules (the “Rules“) are the official rules governing the ‘Artist Awards.’
2d. Use of the Dance Track Foundation or Dance Track Magazine Web site is governed by the terms and conditions and the outline privacy policy of Dance Track Foundation and Dance Track Magazine posted on the Dance Track Foundation or Dance Track Magazine Web site at www.DanceTrackFoundation.org and www.DancetTrackMagazine.com (the “Terms and Conditions“).
2e. By entering a Nomination Form, each entrant acting on his/her own behalf and each Group Representative (defined in paragraph 3b below) acting on his/her own behalf and for and on behalf of each entrant in his/her Group (defined in paragraph 3b below) acknowledges that he/she has read and understands the Rules and the Terms and Conditions.
2f. By entering the Nomination Form and making a submission and in consideration for the acceptance of a submission by Dance Track (the sufficiency of which is hereby acknowledged), each entrant acting on his/her own behalf and each Group Representative acting on his/her own behalf and for and on behalf of each entrant in his/her Group irrevocably and unconditionally agrees to comply with and to abide and be bound by the Rules and the Terms and Conditions.
2g. The Rules and the Terms and Conditions shall be construed according to and governed exclusively by the law in the state of California and each entrant acting on his/her own behalf and each Group Representative acting on his/her own behalf and for and on behalf of each entrant in his/her Group agrees to submit to the exclusive jurisdiction of the courts in the state of California.
2h. Dance Track Foundation reserves the right to amend the Rules and/or the Terms and Conditions at any time without prior notice. Any amendments to the Rules and/or the Terms and Conditions will be posted on the Dance Track Foundation Web site at www.DanceTrackFoundation.org and ArtistAwards.net, e-mailed to the e-mail address provided on the Nominating Form (defined in paragraph 4 below) corresponding to each submission or communicated in such other manner (if any) as Dance Track Foundation shall in its sole and absolute discretion consider appropriate.
3. ELIGIBILITY
3a. As set out in paragraphs 4 below, nominations are open to all persons working in the United States of America from any geographic location PROVIDED THAT such persons have up-to-date union status (in SAG, AFTRA, AGMA, AGVA, ACTRA, Actors’ Equity) and/or are represented by a SAG or AFTRA franchised agent or manager (as of November 1, 2011).
3b. A submission may be made either (i) by a single eligible entrant or (ii) for and on behalf of a group of eligible entrants (a “Group“). Every Group entering the Nomination Form must all be represented by a SAG or AFTRA franchised agent or manager (they do not all have to be represented by the same agent or manager but must all have representation). Every Group entering the Nomination Form must have one single eligible entrant who shall act for and on behalf of every member of the Group (the “Group Representative“). All of the members of the Group must consent to entering the Nomination Form prior to the Submission being made.
3c. Employees of Dance Track Foundation or of any company involved in the Dance Track Artist Awards and any such person’s agents or family or household members are not eligible to enter the Dance Track Artist Awards, either on their own behalf, as a single entrant or as part of a Group.
3d. Dance Track Foundation reserves the right to verify the eligibility of any nomination applicant, including any member of a Group, at any time and by such methods as it sees fit.
4. ENTRY REQUIREMENTS
4a. The Nomination Form may only be entered during the period from November 1, 2011 at 9:00 am Pacific Standard Time to December 31, 2011 at 11:59 pm Pacific Standard Time.
4b. There is no fee required to submit a Nomination Form.
4c. All Dance Track Artist Awards categories require either a video or audio submission and must be accompanied by the Nominating Form and a hard copy (DVD or CD) of the eligible work. ALL Categories requiring a video submission are listed under the Performance, Film/TV/Music Video/ Choreography, Music and Favorite Dance Category. The ONLY Dance Track Artist Awards Category that does not require a video or audio hard copy submission is the Representation Category.
To enter a Nomination Form, Download the form from the Dance Track Foundation or Artist Awards Web site and mail in your completed form along with your hard copy DVD or CD submission to: Dance Track Foundation, Attn: Artist Awards, 155 W. Washington Blvd. PH1, Los Angeles, CA 90015. Nomination Forms will not be accepted via e-mail.
4d. The Nomination Form must be properly completed and Dance Track Foundation reserves the right to refuse, in its sole and absolute discretion, to accept any Submission accompanied by an improperly completed Nomination Form.
4e. Once the top 3 submitted nominees in each category (or 5 in the favorite categories) have been determined by the Editorial Staff and selected industry professionals, each nominee’s name and the work title for which they were nominated will be listed on our 2012 Nominees page on the Dance Track Foundation and Artist Awards Web sites. Each eligible voter, must register to vote via the Register To Vote portion of ArtistAwards.net. You will then receive a confirmation of registration and code that you can use to watch the nominated videos on a closed portion of the www.ArtistAwards.net Web site.
The ONLY category to be voted on by the public will be the Favorite Dance Category. Videos for these nominees with their names and titles for the work in which they were nominated will also be posted on the “2012 Dance Track Artist Awards Nominees” page, on a separate open voting page on the ArtistAwards.net Web site and on the Dance Track Magazine Web site. Each Favorite Dance Category Nominee Submission will be hosted by YouTube only in accordance with YouTube’s terms of use found at www.youtube.com/t/terms. For a submission to be valid, the URL of the video on YouTube must be correctly noted on the Nomination Form. The URL enables Dance Track Foundation to identify a Nomination.
4f. Each Nomination must be made in accordance with the Rules, including the Submission Criteria set out in paragraph 5 below. Any Submission that fails to satisfy the entry requirements will not be eligible to be nominated.
4g. Dance Track Foundation reserves the right to determine, in its sole and absolute discretion, whether a Submission satisfies the entry requirements and is eligible for the Artist Awards.
4h. Nomination Entries will only be complete once confirmation of acceptance of the submission is e-mailed by Dance Track Foundation to the e-mail address provided on the Nomination Form corresponding to the relevant submission. Receipt of a confirmation e-mail does not constitute acknowledgment by Dance Track Foundation as to the eligibility of a submission.
5. SUBMISSION CRITERIA
5a. Content criteria
Each Submission must:
(a) showcase an eligible applicant or a Group performing an original audition piece and/or previously published piece of dance (i.e. clip from a TV show, commercial, film); and/or
(b) showcase an eligible applicant or a Group’s work in its entirety (i.e. Film/TV/Music Video Category); and/or
(c) showcase the recording artist’s album or song in its entirety (i.e. Music Category).
ALL submissions must include a high-resolution photo of the individual or group being submitted with their Nomination Entry Form and DVD/CD video or audio clip. The photo must be of the individual or group that is being nominated for their particular category. You must include the names of all who appear in the photograph from Left to Right. Please write the names in ALL CAPS or type them onto the form. Photos must be high resolution (at least 300 dpi) and have the consent for use by the photographer (photographer’s name must be listed).
Submissions must NOT:
(a) contain any material which is sexually explicit, obscene, pornographic, violent, discriminatory, illegal or otherwise offensive, threatening, profane or likely to be detrimental to the reputation of the Dance Track Artist Awards and/or Dance Track Magazine; or
(b) be the performance of or include any copyrighted material (including any music used for the dance routine) or otherwise include a trademark, logo, insignia, signage or photograph of any third party. This only applies to the Choreography category as the work of the choreographer must stand on its own and have no representations of copied or borrowed-without-asking whole segments.
5b. Technical criteria
A submission for Nomination in the Open Voting Favorite Dance Category must be in a format accepted by YouTube. Information on the format of videos that may be uploaded to YouTube can be found at: http://www.google.com/support/youtube/bin/answer.py?answer=55744&topic=10523
You must be able to provide Dance Track Foundation with a viable link to your YouTube clip for the Favorite Dance Category.
6. THE STAGES OF THE DANCE TRACK MAGAZINE ARTIST AWARDS
The Dance Track Artist Awards has two stages:
Stage 1
Each eligible submission will initially be reviewed in Stage 1 of the Dance Track Artist Awards by a Dance Track Foundation staff member to make sure the submission is eligible.
The Dance Track Staff based on the most number of submissions will select the top 3 submission-getters in each category of the submissions process to be official “Nominees.” In the event of an equality number of Submissions, the Dance Track Foundation staff will place up to the top 5 in each category based on the number of submissions. These nominees shall be put forward to Stage 2 of the Dance Track Artist Awards process. The Dance Track Foundation Staff also provide one submission per category in the event that there are no submissions for a category or if there are no eligible submissions in a category. These will not be put forward if there are eligible submissions in each category.
The Submissions put forward to Stage 2 of the Dance Track Artist Awards, and the identity of the entrant or Group (the “Nominees“), will be revealed on the Dance Track Foundation and Artist Awards Web site and in such other manner (if any) as Dance Track Foundation shall in its sole and absolute discretion consider appropriate on or about 1:00 pm Pacific Standard Time on January 4, 2012 (or as soon as reasonably practicable thereafter).
Stage 2
(together the “Additional Criteria“).
For the Open Voting Favorite Dance Category: The Nominees’ submissions will be judged by such members of the public who register their vote on the Dance Track Artist Awards Web site at www.ArtistAwards.net from 9:00 am Pacific Standard Time on January 4, 2012 to 5:00 pm Pacific Standard Time on February 15, 2012 (the “Deadline“).
Ballots will be available online only on the Dance Track Web site at www.ArtistAwards.net.
The votes will be tallied by the Dance Track Foundation Staff and certified by an outside accounting firm. Dance Track Foundation staff will declare the Nominee Submission receiving the largest number of votes in the Special Artist Awards Digital Issue of Dance Track Magazine on April 15, 2012. In the event of an equality of votes, all of the tied categories will be presented as such in the digital publication and at the awards event.
The winners of the Dance Track Artist Awards will be the applicant or Group identified on the Nomination Form corresponding to the Winning Submission (the “Winning Nomination(s)“). Dance Track will reveal the Winning Nomination(s) on the Artist Awards Web Site and the Dance Track Magazine Web site at www.DanceTrackMagazine.com and at www.ArtistAwards.net and in such other manner (if any) as Dance Track Foundation in its sole and absolute discretion considers appropriate at 1:00 pm Pacific Standard Time on April 4, 2012 (or as soon as reasonably practicable thereafter).
7. THE PRIZE FOR THE DANCE TRACK MAGAZINE ARTIST AWARDS
The prize for the Dance Track Artist Awards (the “Prize“) will be awarded to the Winning Nomination(s).
The Prize is:
As well as offering a physical award to the winning submission, Dance Track Magazine will showcase the winners in our Special Artist Awards Digital Issue and online at www.DanceTrackMagazine.com.
The Winning Nomination(s) must supply Dance Track Foundation with a photo (high resolution of at least 300 dpi) with the consent of the photographer for use in the Special Artist Awards Digital Issue.
8. THE WINNER OF THE DANCE TRACK ARTIST AWARDS
Subject to this paragraph (8), the Winning Nominee(s) will be eligible for the Prize.
8a. After the Deadline, the Winning Nominee(s) will be contacted in such manner as Dance Track Foundation shall, in its sole and absolute discretion, decide. The Winning Nominee(s) will be required to assign all copyright over the Winning Submission to Dance Track Foundation and may be required to sign a declaration of eligibility, use, indemnity and liability/publicity release. If the Winning Nominee(s) cannot be contacted or otherwise fails to provide such properly executed documents as are required by Dance Track Magazine within ten business days, the Winning Nominee(s) will, unless otherwise agreed by Dance Track Foundation, be deemed to have forfeited the Artist Award.
*Note: In recognizing that the materials being nominated for the Dance Track Artist Awards is copyrighted and protected by its original owners, paragraph 8a will not apply to the work being submitted for review unless the copyright is waived by the original owner and noted on the Nomination Form.
8b. At any time, Dance Track Foundation may in its sole and absolute discretion, disqualify any Winning Submission which Dance Track Foundation considers to be, at its sole and absolute discretion, potentially or actually infringes upon any third parties’ intellectual property rights.
9. USE OF YOUR SUBMISSION, NOMINEE SUBMISSION AND/OR WINNING SUBMISSION BY DANCE TRACK FOUNDATION
9a. Each entrant acting on his/her own behalf and each Group Representative acting on his/her own behalf and for and on behalf of each member of his/her Group:
9b. grants Dance Track Foundation an irrevocable, worldwide license for the duration of the protection of any copyright (and any renewals, reversions and extensions of such copyrights) to:
(i) use, review, assess and otherwise analyze their submission and, as relevant, Nominee Submission and/or the Winning Submission (in whole or in part) in connection with the Dance Track Artist Awards and any future awards held by or in association with Dance Track Foundation or Dance Track Magazine; and
(ii) exploit their submission (only name and likeness from submitted photo – not video or audio unless granted permission in alternate document) and, as relevant, Nominee Submission and/or the Winning Submission (in whole or in part) for any reason whatsoever including (a) commercial exploitation and (b) exploitation in connection with the promotion of the Dance Track Artist Awards and any future awards held by or in association with Dance Track Foundation or Dance Track Magazine, in each case, in all media, whether now known or hereafter invented;
9c. to the fullest extent permitted by applicable law, waives any and all so-called “moral rights” or any similar rights that the entrant or Group may have or hereinafter acquire in the Submission and, as relevant, Nominee Submission and/or the Winning Submission and, to the extent that such rights cannot be waived, consents to Dance Track Foundation doing or omitting to do any act that would otherwise infringe such “moral rights” or any such similar rights;
9d. acknowledges that Dance Track Foundation and/or other entrants in the Dance Track Artist Awards may have developed or commissioned materials similar or identical to their own Submission and, as relevant, Nominee Submission and/or the Winning Submission and waives any claims and any right to compensation that may result from any such similarities;
9e. agrees to sign, within ten working days of receipt of a request from Dance Track Foundation, any documentation that may be required for Dance Track Foundation to exploit the rights acquired by Dance Track Foundation under these Rules; and
9f. acknowledges that NO compensation or credit for the use of any Submission and, as relevant, Nominee Submission and/or the Winning Submission will be received by any entrant or Group other than as described in these Rules.
9g. During the course of and following the end of the submission process, as relevant, Nominee Submission for the Favorite Dance Category may be posted (in whole or in part) on one or more web sites selected by Dance Track Foundation for viewing by visitors to that Web site. Dance Track Foundation shall not be responsible for any unauthorized use of a Submission, Nominee Submission and/or the Winning Submission by visitors to such a Web site.
9h. While Dance Track Foundation reserves all the rights described in this paragraph 9, Dance Track Foundation is not obliged to use any Submission, Nominee Submission and/or the Winning Submission for any purpose.
10. FURTHER CONDITIONS OF ENTRY
10a. Each entrant acting on his/her own behalf and each Group Representative acting on his/her own behalf and for and on behalf of each entrant in his/her Group acknowledges and agrees that:
10b. to the fullest extent permitted by applicable law, none of Dance Track Foundation, its parents, subsidiaries, affiliates, officers, employees, assignees, licensees or agents shall be liable for any injury, loss, damage, right, claim or action of any kind arising from or in connection with the Dance Track Artist Awards or with the Prize; and
10c. Dance Track Foundation may use the name and place of residence of any entrant or Group in any media in connection with the Dance Track Artist Awards without payment or compensation to such entrant or Group.
10d. In relation to their Submission and, as relevant, Nominee Submission and/or the Winning Submission, each entrant acting on his/her own behalf and each Group Representative acting on his/her own behalf and for and on behalf of each entrant in his/her Group warrants, represents and undertakes that:
10e. the Submission and, as relevant, Nominee Submission and/or the Winning Submission is the original work of the eligible entrant or of the Group;
10f. the Submission and, as relevant, Nominee Submission and/or the Winning Submission only includes material (including music, video or images) that the entrant owns, that is a Permitted Track or in respect of which the entrant or Group has permission from the copyright, trademark or any other intellectual property owner to use in the manner anticipated by the Dance Track Artist Awards and these Rules; (Please note that all clips submitted from TV/Commercial/Music Video/Recording Artist Tour/Freestyle Audition will not be posted on the main Dance Track Foundation and Artist Awards Web site as they are under copyright unless otherwise specified on your Nomination Form. The clips Nominee clips will be posted on a secure password protected portion of the site for review by eligible voters casting their ballots via mail.
10g. all necessary permissions and consents to submit the Submission and, as relevant, Nominee Submission and/or the Winning Submission in the Dance Track Artist Awards have been obtained including, but not limited to, from any person that appears in the Submission, Nominee Submission and/or the Winning Submission;
10h. the Submission and, as relevant, the Nominee Submission and/or the Winning Submission for the Favorite Dance Category complies with the YouTube terms of use, available at www.youtube.com/t/terms.
10i. Each entrant acting on his/her own behalf and each Group Representative acting on his/her own behalf and for and on behalf of each entrant in his/her Group warrants, represents and undertakes that, in submitting for the Dance Track Artist Awards, he/she is complying with, and the Dance Track Artist Awards is not in violation of, the laws of his/her jurisdiction.
10j. In relation to each Group represented by him/her, each Group Representative acting on his/her own behalf warrants, represents and undertakes that he/she has full authority to make the agreements, acknowledgments, warranties, representations and undertakings on behalf of each entrant in such Group.
10k. Each entrant acting on his/her own behalf and each Group Representative acting on his/her own behalf and for and on behalf of each entrant in his/her Group (jointly and severally) indemnifies and keeps Dance Track Foundation (for itself and on behalf of each of its parents, subsidiaries, affiliates, officers, employees, assignees, licensees or agents) fully and effectively indemnified on demand from and against any and all claims, costs, proceedings, demands, losses, expenses (including legal expenses), liability or damages whatsoever (including any direct, indirect, punitive or consequential loss or damages, or any anticipated loss of profit, loss of profit, loss of opportunity, loss of data, costs and fines and/or any special or incidental damages of any kind) arising directly or indirectly as a result of (i) any breach or non-performance by the entrant(s) of any of the Rules, of the representations, warranties and undertakings contained in these Rules, or (ii) of the inaccuracy or untruthfulness of any such representations and warranties or of any use of the rights granted and/or materials supplied by the entrant, or on his/her behalf, to Dance Track Foundation pursuant to these Rules.
11. MISCELLANEOUS
The decisions of Dance Track Foundation are final and binding on all matters related to the Artist Awards, in particular but not limited to the interpretation of these Rules and the Terms and Conditions, the application of the Rules and the Terms and Conditions to any entrant or Group or any prospective entrant or Group and whether the Rules have been breached by any person. These Rules along with the Terms and Conditions constitute the entire agreement between Dance Track Foundation and each entrant or Group in relation to the Dance Track Artist Awards.
12. DISQUALIFICATION
Dance Track Foundation may disqualify any entrant who at any time is considered, in Dance Track Foundation’s sole and absolute discretion, ineligible for the Artist Awards or who has breached the Rules or the Terms and Conditions. If an entrant is disqualified, their Submission (including any Nominee Submission or the Winning Submission) will be removed from the Dance Track Artist Awards.
13. CANCELLATION OF THE DANCE TRACK FOUNDATION ARTIST AWARDS
Dance Track Foundation may, in its sole and absolute discretion, cancel, amend or suspend the Dance Track Artist Awards (in whole or in part) if for any reason the Dance Track Artist Awards (or any part thereof) becomes impossible or impractical to complete or if any malfunction, event or activity occurs that may adversely affect the integrity of the Dance Track Artist Awards (or any part thereof).
